Or to voice your reservations with a beer in hand—we see that happen quite often.

A pioneering role at festivals

Our team has appeared at dozens of festivals. You can find De Herborist at Sfinks Festival , PharmaForum , BioExpo , Vegan Vibes , and international trade fairs. Their gentle and professional approach to skincare and CBD oil makes them the perfect partner for festivals that want to maintain a healthy, family atmosphere. Until 2023, we operated our stores under the name Florapoint . We sold legal flowers , had a fun photo wall, and maintained clear agreements with the organization and local governments. As pioneers, we sparked conversations.

Legislation and policy

New regulations regarding tobacco sales have been in effect since 2025. As a result, CBD may no longer be sold at events or festivals. This is despite the fact that CBD is currently the only taxed, legal form of cannabis in Belgium. In fact, even those who legally purchase CBD with an excise stamp and sealed packaging often see it confiscated by the police upon arrival. This shouldn't be allowed.

We asked the police department: are users allowed to file a report requesting laboratory analysis? Or is an amicable settlement always proposed? Unfortunately, the latter still seems to be the standard. Every year, hundreds of visitors pay a fine of around €180 for something that was legally purchased and taxed. According to the federal classification, CBD falls under "smokable herbs other than tobacco," and is therefore, in principle, permitted for public consumption.

The policy has been inconsistent for years. While the federal government recognizes CBD as legal, local enforcement is often based on moral or gut feeling. VAD's vision is aimed at deterrence, but clashes with the reality that CBD tobacco products have been legal since 2019.

Not legal? Then back to the black market

Earlier this year, some women at a festival asked for a safe CBD vape. We weren't allowed to sell them anything. Ten minutes later, we saw them on a bench with two strangers, who apparently did have something to sell. This is the result of banning what's legal, tested, and safe. Meanwhile, at festivals like Tomorrowland, it turns out that thousands of people are still using drugs.

Why then ban the safe alternative?

Drug dogs that smell CBD?

At one festival, we were told that drug detection dogs could detect our products (from De Herborist) containing hemp seed oil. This is scientifically incorrect: dogs are trained on Delta-9 THC , not hemp seed. The Federal Public Service Health confirmed to us that our products are 100% legal and that the federal police are not authorized to impose local regulations. Fortunately, we were allowed to remain on site.

    Legally: yes. In practice: often not. Police often confiscate it anyway, despite the excise stamp. Always request a report and have it analyzed.
  3. What is the penalty for small amounts of cannabis?
    Often an amicable settlement (€150-200). Repeat offenses, or if you are under 18, can result in a criminal record or a police report.
  4. Is it dangerous to combine CBD with alcohol or drugs?
    Yes, that's possible. CBD itself is safe, but when combined, it can enhance or weaken its effects.
  5. Can drug detection dogs smell CBD?
    Only if it contains traces of THC. Products without THC are normally odorless to dogs.
  6. Is consuming CBD at a festival safe?
    Content: yes. Legal: depends on the local police's stance. Use discreetly and with packaging and label.
